HDR Order and Payment Terms for Customers and Dealers

Highland Daytona Racing provides the following payment terms information. Highland Daytona Racing accepts wire transfer, certified checks or cash only.

Upon receipt of your order, you will finalize your car's specifications, along with any personal measurements for driver cockpit sizing with HDR's sales staff and production manager.

Cobras and Custom Hot Rods - Non-Escrow Clients
1) A $5,000 deposit will guarantee a production start date slot, along with the guarantee of no additional price increases. This deposit must be accompanied by the provided signed documents provided by Highland Daytona Racing.
2) The remaining portion of the initial 50% of the total price after options is required (30) thirty days' prior to your build document's stated production start date. The break-out of your car's costs and deposit schedule will be found on your production build sheet.
3) An additional 25% progress deposit is required (14) fourteen days after the initial 50% deposit.
4) Remaining balance will be due (14) fourteen days' prior to shipping of the car. Customers are always invited to the factory for final inspection. If you are not able to visit, Highland Daytona Racing can supply detailed digital photos.

Escrow Protection
Highland Daytona Racing, in partnership with the Keystone Nazareth Bank & Trust (KNBT) Bank of Pennsylvania, offers a total customer protection escrow account vehicle which is totally monitored by representatives of the KNBT bank during the production process of your car. Costs
Prices do not include any federal, state or local taxes or other governmental fees, assessments or charges on articles. Wherever applicable, the taxes or other fees, assessments or charges will be for the account of buyer and may be added to the invoice as a separate charge to be paid by buyer. Omission of any taxes or fees does not limit buyer's obligation for payment.

Cost of transportation from Highland Daytona Racing plant will be on buyer's sole account and expense. Highland Daytona Racing reserves the right to select the means of shipment and carrier, if any, unless specific shipping instructions are received from buyer. Buyer assumes all risk of loss to the product after the product leaves Highland Daytona Racing's facility in Allentown, PA.

Highland Daytona Racing Warranty
I HAVE READ THE WARRANTY AGREEMENT ON THE OTHER PAGES OF THESE DOCUMENTS AND AGREE TO THEM AS PART OF THIS ORDER THE SAME AS IF THEY WERE PRINTED ABOVE MY SIGNATURE. ALL THESE DOCUMENTS COMPRISE THE ENTIRE AGREEMENT AFFECTING THIS ORDER AND NO OTHER AGREEMENT OR UNDERSTANDING OF ANY NATURE CONCERNING SAME HAS BEEN MADE OR ENTERED INTO. EXCEPT AS STATED ON THE FACE HEREOF, NO WARRANTY WHETHER OF MERCHANTABILITY, FITNESS FOR PURPOSE OR OTHERWISE EXPRESS OR IMPLIED IN FACT OR BY LAW, IS OR SHALL BE APPLICABLE TO VEHICLE PRODUCTS SOLD HEREUNDER. HIGHLAND DAYTONA RACING AND ITS DIRECT AND INDIRECT SUPPLIERS/VENDORS SHALL HAVE NO OTHER OR FURTHER LIABILITY BY REASON OF THE MANUFACTURER OR SALE OF ANY VEHICLE PRODUCTS SOLD HEREUNDER OR OF THEIR USE, WHETHER ON THE BASIS OF BREACH OF WARRANTY, STRICT LIABILITY, NEGLIGENCE OR OTHERWISE. IN NO EVENT SHALL HDR OR ITS DIRECT OR INDIRECT SUPPLIERS/VENDORS BE LIABLE FOR GENERAL, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES RELATING TO PROPERTY DAMAGE OR ECONOMIC LOSS, (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF USE OR LOSS OF PROFITS). THIS AGREEMENT WILL BE GOVERNED BY THE UNIFORM COMMERCIAL CODE AS ADOPTED IN THE STATE OF PENNSYLVANIA AS EFFECTIVE AND IN FORCE ON THE DATE OF THIS AGREEMENT. ANY LEGAL PROCEEDING RELATED TO THE PRODUCTION OF THE VEHICLE OR TO ANY TRANSACTION BETWEEN HIGHLAND DAYTONA RACING AND BUYER SHALL BE BROUGHT IN PENNSYLVANIA, WITH PROPER VENUE BEING LEHIGH COUNTY. IN THE EVENT THAT LEGAL PROCEEDINGS ARE FILED WHICH ARE RELATED TO THIS TRANSACTION, THE NON-PREVAILING PARTY AGREES TO PAY ALL OF THE PREVAILING PARTY'S COST, REASONABLE ATTORNEY FEES AND EXPENSES.
